Any citizen CAN start a petition and present it to the City Council, whether or not they listen is up to the council itself. Unfortunately, because the ordinance was Crawford's baby, he took all the heat for it, but we re-elected just about everyone else who voted in favor of the ordinance. It would take some pretty incredible political manuevering to have it overturned with them still in office.

The best way to fight it may actually be civil disobedience. Just ignore the ban, and the fines until it all goes to court. Challenge the legality of the law itself. Would at least bring the fight to the attention of EVERYONE, and probably force some kind of action out of the council.

I actually LOVE tiny's most recent suggestion. Allowing bars to set their own rules, and proclaim them with a big-ass plaque on the door does seem like a fair way to deal with it. That also allows the market to determine things. If bars really are seeing the foretold (by Crawford) upswing in business from non-smokers then they are welcome to continue being a non-smoking establishment. If not, well, the taxpayer will make that decision on their own won't they? And isn't that what has seemed right all along?

Las Vegas has a no smoking ordinance except in the casinos. Every other place is non smoking, but the casino floors are fair game. Making a rider or amendment that allows bars to set their own policy is surely the best way to go. Then you have the option to choose a) whether you work there and b) whether you frequent the establishment.

not completely true.

Las Vegas is non smoking unless food is servered. My favorite corner bar there was the Blue Diamond Saloon. When the non smoking law went into effect they completely ditched their kitchen in order to stay a smoking establishment.

Same with Florida, they had a nice law that was similar. if more then 30% of their sales was food then the business could not legally allow smoking.

So some bars cut the menu down, and some opened smaller smoking bars without kitchens next door to their already established business.

Our retarded ass law offeres no good solution. I am sorry but heated smoking decks is just a waste of money to build and energy to run.

frankly, I'm tired of businesses using the smoking ban as an excuse for A. going out of business and B. (especially B.) paying musicians on average 50% of what we were making two years ago. I call bullsh*t! And I am 100% opposed to this stupid legislation, but for other reasons.
