BTW, he is STILL in jail. The prosecuting attorney decided to appeal....

Actually I was refering to the domestic violence situation in Michigan. I think Indiana's the same way now.

As far as this case, I believe the girl's parents were pretty peeved about it (hey, the jerk videotaped their little girl giving him oral sex, find me a parent who wouldn't want to kill him), but even they didn't want this.

If I was him, I'd be mad as hell at whoever was showing this videotape around too. Note to young people - DO NOT VIDEOTAPE PARTIES!!! It will be used as evidence.

Yeah, I guess I am less peeved about it then...I mean, I certainly think the law sux ballz, but you do have a couple idiot kids not only videotaping it but letting it get out...just kinda dumb. Not 10 years in jail dumb, but still pretty retarded.

I guess the worst part is, they seem to be changing the law, yet they aren't making it retroactive...not quite sure I understand that. I mean, you can't prosecute someone if they did something illegal before it was illegal, so it would make sense they would retroact a "bad law" once it had changed...

That's what the judge used as her reasoning for re-sentencing. However, it does open precedent to any similar offense being opened to re-sentencing.

I understand WHY they DA appealed, but they should get him released on bond and then plea is down to a misdemeanor.
