This Sunday October 22nd Kevin Ferguson made some FALSE comments at the beginning of the show about the former host band Action Jaxson. Kevin Basically said that Action Jaxson failed to show up.

Actually the truth is Kevin wouldn't pay us and we agreed to play a couple more shows with him before and not leave him hanging. He said after completing these couple of shows there would be a break that we could decide if we wanted to come back or play the show so many times a month ect...

Basically Kevin Lied and set us up. I was there with WILL BROWN aka HDM when the conversation with Kevin went down. We even had a couple of shots shortly after the conversation at Kevin's generousity. So basically the guy pulled some really shady sh*t on us. I've heard that Kevin was trouble for other bands in the area and I want this to be the last time.

I'm asking people to Boycott his show and bands to NOT play his show.
Kevin might come across as a nice person when you meet him but he is really full of himself. We talked to him in a respectable business manner and he lied to us and bashed our name on TV.

Apparently Kevin is looking for another band. Cause you know.. he likes scaring them away. lol So I'm asking EVERY local band in this area to not go that route. It's not worth it. Trust me..

Did you have a contract ? If not, oh well...............no recourse..of course.

No contract.. But he doesn't really treat area bands with any respect. No need to talk sh*t about a band that did yah good service with a smile. I'm basically asking all music fans and bands to stick up to Kevin ferguson by not performing at or going to his venue. Kevin thinks that he is the best thing on God's green earth.


And he feels that he can treat musicians like sh*t whenever he wants just because he knows bands will want to get on his show to be on television.

This is why I'm asking everyone to Boycott because to alot of us playing music isn't just recreation , it's a business. Action Jaxson did the show since June. When we talked to Kevin he claimed he understood why we couldn't do the show anymore. one week after our last show he calls us up telling us our name is ruin (which is bs) and that we were suppose to be on the show after we already agreed we wouldn't be there.

That's pretty shady. I'm telling everyone this because he doesn't have any respect for what musicians do. He thinks as long as he has a TV show that bands will continue to flock to him and he can treat them anyway he wants to. This is only true if we let him. this is why I'm asking everyone to Boycott his show.

Plus his jokes are as brutal as the holocaust...

Irregarless as to the degree of butthead he may be,,,if you're going to be in this business (music), you better learn the ropes.
#1. YOU DON'T WORK WITHOUT A CONTRACT
#2. MAKE SURE IT SPELLS OUT ALL THE CONDITIONS YOU WILL
BE WORKING UNDER.
You can believe his comics that come on the show have contracts.
This protects you and him. It give recourse to take him to court if he violates the conditions of the contract. Boycotting his show only hurts yourself.

...and be sure not to use "Irregarless" in your contract.

I am sorry to hear you guys got screwed like that. It is normal not to get a contract when you are playing around this town. I have been playing bars and clubs around Fort Wayne for 8 years with many different bands and never have gotten a contract, it just isn't a standard practice around here. You go to the club, ask for a date, they write you down, then you show up, play and get paid. I have maybe had one or two instances where we got shorted money initially, but it was resolved.

Sorry, but I disagree. Recordstar has an absolutely valid point. The only recourse you will ever have is if it is in writing, regardless of how much you are getting paid. A gig is a gig. If you are doing it for fun and don't care if you make $5, then Merry Christmas to you. For those of us that actually care about how much we make it's a different story. By the way, the calendar behind the bar with your bands name written in on such and such date DOES NOT count. I've watched bar owners simply scratch out the name of the band on the calendar to replace it with another. YOU may consider it "normal" to play without a contract, but I do not. Funny thing was, we agreed to his crappy dollar amount and he still didn't sign the papers.

contracts are the way to go..................it benefits the organizer and the band. The band will get paid what the contract says, and the norganizer will have something to fall on if the band decides to 'split shift'.
We;re organizing that metal concert in december and we had every band sign a contract stating that if they 'split shift' on us, that the hundred dollar profit that they would make selling their tickets (prepaid) would have to be returned to us. Contracts are a great thing for security.

Look, it is great if you guys can get contracts, but the fact is around here it just doesn't happen very often, and if you present one it probably wont be signed or returned.

I've dealt with Legends, Sneaky Pete's, CSW, Piere's, Industrial Joe's, Checkerz, Club Atlantis, Martins, Peanuts I & II, Sunset Hall, Cup-a-Joe's, The Jam Crib, The Latchstring, Toast and Jam, and a few others I can't recall in the last 10 years.

Not one contract.

Not one bad experience.

Verbal agreements did the job.

However, if you have expectations and a reason not to trust a venue, prepare your own agreement prior to negotiations, leave blanks for the venue, name of the band, date, time, and pay terms; discuss all of the terms with the venue, record them, ask them to sign it. Even if they don't sign it, at least you have a record of what you discussed. It's not binding in any way, but when you book 2 or 3 months out, it can be easy to forget the details of any agreement.

Seriously, though, you have to have a bullsh*t filter. . .and you have to explicitly state your expectations and get the booking rep to agree to them. I've been real lucky at not getting taken, but I'm also one of those who isn't concerned with the amount as long as it's fair. I play out to support my stage addiction and not to make money, though I sometimes think it would be fun to put together a money making music machine. I can call it M4.
